Terms of service

The agreement between you and TopWapi. Written to be read rather than to be survived.

1. Agreement

By creating an account or using TopWapi you agree to these terms. If you do not agree, do not use the service. We may update these terms; material changes will be announced on this page with a new effective date, and continued use after that date constitutes acceptance.

2. Your account

You must be at least 16 years old and provide a working, permanent email address. You are responsible for keeping your password confidential and for everything that happens under your account. One account per person; you may not create additional accounts to gain additional listings, credits or leaderboard positions.

3. Your listing

Each account may list one website. You represent and warrant that you own or are authorised to represent that website. You are responsible for the accuracy of the title, description, URL and category you provide.

4. Prohibited content and conduct

You may not list or promote:

  • Malware, phishing pages, or sites that attempt to install software without consent.
  • Adult or sexually explicit content.
  • Content that is illegal where our members are located.
  • Content that infringes the intellectual property of others.
  • Sites that consist primarily of scraped or automatically generated content.
  • Sites whose destination differs materially from the listing description.

You may not:

  • Generate artificial clicks, promotional visits or credits by any automated or coordinated means.
  • Attempt to reverse engineer, overload, or interfere with the platform or its counting mechanisms.
  • Misrepresent your identity, your ownership of a website, or your metrics.
  • Scrape member data or contact members for unsolicited commercial purposes.

5. Credits

Credits are a platform-internal unit of promotional value. They have no monetary value, are not transferable between accounts, cannot be purchased, sold or exchanged for cash, and may be adjusted where we determine they were obtained in breach of these terms. Credits do not survive account termination.

6. Leaderboard and metrics

We compute leaderboard position and all published metrics using the methodology described at /how-it-works. We may adjust, recalculate or remove metrics that we determine are the result of automated, coordinated or fraudulent activity. Our determination is final for the purposes of ranking.

7. Intellectual property

You retain ownership of the text and images you submit. By submitting them you grant us a worldwide, non-exclusive, royalty-free licence to display them on TopWapi and in promotional material for the platform. The TopWapi name, logo, design system and source code are ours.

8. Availability

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, a specific volume of traffic, a specific leaderboard position, or any particular search engine outcome. We may change, suspend or discontinue features at any time.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service. Where liability cannot be excluded, it is limited to the greater of the amount you have paid us in the twelve months preceding the claim, or one hundred US dollars.

10. Termination

You may delete your listing or close your account at any time. We may suspend or terminate your account if you breach these terms, if we are required to by law, or if your listing presents a risk to other members. Serious breaches — automated traffic generation, malware, impersonation — result in permanent removal.

11. Privacy

Our handling of data is described in the privacy policy, which forms part of these terms.

12. Governing law

These terms are governed by the laws of the jurisdiction in which TopWapi is established, and disputes will be brought before its competent courts. If any provision is found unenforceable, the remaining provisions continue in effect.
